Abstract

Reports that the recommendations of the 2011 Law Commission Report "Easements, Covenants and Profits a Prendre"are soon to be considered by Parliament. Comments on the proposals to revoke the rule in Austerberry v Oldham Corp (CA) the positive freehold covenants cannot burden land, and treat easements, covenants and profits as part of a uniform system of proprietary interests.
